RELEASE AND WAIVER INDEMNITY AGREEMENT

I agree to release and forever discharge and hold harmless Homesteaders of Iowa  and its successors and assigns from any and all liability, claims, demands, and causes of action, of whatever kind of nature, either in law or equity, which may hereafter arise from my participation with Homesteaders of Iowaand/or any project, activity , or event sponsored, managed, arranged, or promoted by, or otherwise affiliated or associated with Homesteaders of Iowa. 

I further agree to assume all liability for any personal injury or loss of life to any member of the public or anyone accompanying the undersigned or their agents resulting from contact with the undersigned’s display, equipment, or product. 

­­­­Vendor Rules, Regulations, and Responsibilities

  1. HOI Expo will be held rain or shine.  All vendor spaces are in Bridgeview’s Expo Hall.
  2. Vendor Booth shall include a 10-foot by 10-foot space, two tables, two chairs, and tablecloth & skirting. 
  3. Vendor fees are listed on the Vendor Application Form and are NON-REFUNDABLE.
  4. Vendors will set up their booth(s) the day before opening day unless prior arrangements are made.
  5. Vendors will be ready to sell at opening time and will remain until the appointed closing time.
  6. The “Vendor Manager” reserves the right to assign spaces.
  7. The use of banners or the like to say who you are is encouraged.  They should be placed within your booth.
  8. No animals allowed in the vendor area without permission.
  9. All vendors will act in a professional manner.  They shall not shout, use profanity, play music, or display product in a way that is offensive to anyone, either by sight, sound, or smell. 
  10. All vendor items must be contained withing their own vendor booth area.  Nothing shall spill over into an adjacent booth or into the walkway.
  11. Due to the allergies and sensitivities of others, any items with fragrance should be very mild or wrapped in such a way that the fragrance does not travel outside of the vendor’s booth area.
  12. This is a family event, so use of alcohol or non-alcohol look-alike products are not allowed at vendor booths.
  13. Prohibited items for sale:  Alcohol or non-alcohol look-alikes, Tobacco Products, or any like product . . .
  14. All items should be something of interest to homesteaders.  The “Vendor Manager” reserves the right to use discretion in any product that they deem to not be in the best interest of the group.
  15. Any vendor selling food or skin-care products must have the ingredient list available for anyone who requests to read the ingredients.   We understand there may be proprietary ingredients in these products.  Our goal is to protect those who may have allergies or sensitivities. 
  16. Compliance with Governmental Regulations: Vendor must comply with all applicable federal, state, and local codes, ordinances, rules and regulations, including, but not limited to: sales tax, food handling, fire (no open flames), utility, public safety, and health & building codes & regulations. Any food products must be packaged.
  17. If the Event must be adjusted or cannot occur due to force majeure (extraordinary, unforeseeable circumstances), the responsibility of Homesteaders of Iowa shall be exempted in part or in whole according to the influence of force majeure, at the discretion of the Event Coordinator(s).
  18. Vendor’s violation of any rules may result in immediate termination of this agreement without the refund of any fees.  The “Vendor Manager” is authorized to give warnings, require rule breakers to contain or stop selling products, and/or require rule breakers to leave the event.
  19. By signing the application, you are agreeing to these rules, regulations and responsibilities.
